Our client sustained injuries when an uninsured driver failed to yield the right of way on North Rock Road in Wichita. The insurance company offered $24,500 and denied our client was entitled to payment for future medical expenses as our client had not sought treatment for 18 months, was not complaining of pain and had full range of motion in his neck. Defense counsel also claimed that both parties shared responsibilities for the collision. The jury found the uninsured motorist 99% at fault and awarded damages for economic loss to date, past and future noneconomic losses to day, and past and future medical expenses. The judge also demanded the insurance company pay our client’s attorney fees and costs associated with the jury trial; in addition to the verdict.
